On Monday, a federal judge declined a House request to prevent US president Trump from tapping Defence Department monetary for Mexico wall. He said Congress lacked authority to sue. Thus, Federal judge rejected Congress’ challenge of US Mexico wall funding
Last month, Trump’s victory silenced by California federal ruling. It blocked to build the key sections of the US Mexico wall.
Trump appointed US district judge Trevor McFadden. The judge wrote that the House’s lawsuit was “about whether one chamber of Congress has the ‘constitutional means’ to conscript the Judiciary in a political turf war with the President over the implementation of legislation.”
McFadden said Congress doesn’t hold any authority regarding the case. However, he also mentioned that it doesn’t mean that the legislative body could never challenge the president in court over the distribution of powers.
He wrote, “An old maxim in politics holds that ‘Where you stand depends on where you sit. At law too, whether a plaintiff has standing often depends on where he sits. A seat in Congress comes with many prerogatives, but legal standing to superintend the execution of laws is not among them.”

Moreover, The Justice Department welcomed the judge’s decision. It said, the judge rightly ruled that the House of Representatives can’t ask the judiciary to take its side. Also, it cannot use federal courts to accomplish through litigation what it cannot achieve using the tools the Constitution gives to Congress.
On 24th May, a federal judge in Oakland ruled Trump misused his authority and blocked work of two most prior Pentagon-funded project.
Reportedly, the administration is willing to appeal the ruling by Haywood Gilliam Jr. He was appointed by former US President Barack Obama.
Billions of the dollar are at stake due to Trump’s proposed will of making US Mexico wall. It’s his second term bid.
Earlier, in February, Trump declared a national emergency after losing a fight with the Democratic-led House. It resulted in 35-days government shutdown and $8.1 billion amount for wall construction.
Along with this, the funds also comprise $3.6 billion finances military construction funds, $2.5 billion from Defence Department counterdrug activity. Not just that, it also includes $600 million from the Treasury Department’s asset forfeiture fund.
So, this was everything about Congress’ challenge to US Mexico wall funding. However, the federal judge rejected it.
